Annual Leave and Long Service Leave in Australia: Your Full Entitlements
Leave entitlements are some of the most valuable employment rights in Australia, yet many workers don't know exactly what they're owed — particularly when it comes to long service leave and the 17.5% leave loading that applies when taking paid annual leave.
Annual Leave — Fair Work Act Minimums
Under the Fair Work Act, all full-time employees are entitled to 4 weeks (20 days) of paid annual leave per year. Part-time employees accrue annual leave pro rata based on their ordinary hours. Key rules:
- Leave accrues continuously from day one of employment
- Unused annual leave is paid out on termination (for any reason)
- 17.5% leave loading applies in addition to base pay when taking annual leave (not necessarily when paid out on termination — check your award)
